TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing localtitan.net or using any LocalTitan service, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our website or services. These terms apply to all visitors, clients, and anyone who accesses or uses our services.

2. SERVICES

LocalTitan provides automated marketing services for local businesses including, but not limited to:

• Lead Lock — missed call text-back automation via SMS
• Reputation Engine — automated Google review request system
• Titan Social — done-for-you social media content creation and scheduling
• Titan Web — website design, hosting, and maintenance

Service specifications, pricing, and terms specific to each service are outlined in your signed service agreement. In the event of a conflict between these Terms and your service agreement, the service agreement controls.

3. PAYMENT & BILLING

• Monthly subscription fees are billed in advance on the same date each month
• One-time setup fees are due at signing and are non-refundable once onboarding has begun
• Failed payments may result in service interruption after 7 days. We will notify you before any suspension
• All prices are in USD. We reserve the right to adjust pricing with 30 days' written notice to existing clients

4. CANCELLATION & REFUNDS

• All monthly services are month-to-month. You may cancel at any time with 30 days' written notice to info@localtitan.net
• Cancellation takes effect at the end of your current billing period. No partial month refunds are provided
• One-time setup fees are non-refundable once work has commenced
• For Titan Web, cancellation of the monthly care plan does not delete your website — access to files will be provided upon request

5. CLIENT RESPONSIBILITIES

To receive our services, you agree to:

• Provide accurate business information during onboarding
• Grant necessary access to accounts required to deliver services (social media, GBP, etc.)
• Respond to onboarding requests within 5 business days to avoid setup delays
• Ensure you have the legal right to use any content, logos, or materials you provide to us
• Comply with all applicable laws, including those governing SMS marketing and customer communications

6. ACCEPTABLE USE

You may not use our services to:

• Send spam, unsolicited messages, or communications to people who have not consented
• Engage in any activity that violates applicable law, including the TCPA, CAN-SPAM Act, or FTC regulations
• Attempt to manipulate Google reviews in violation of Google's policies (we operate fully within those guidelines)
• Use services for industries or purposes we have not agreed to service

We reserve the right to terminate service immediately if these conditions are violated, without refund.

7. INTELLECTUAL PROPERTY

All content on localtitan.net — including text, graphics, logos, and code — is the property of LocalTitan and protected by applicable copyright and trademark law. Content we create specifically for your business as part of a service (e.g., social media posts, website copy) becomes your property upon full payment for those services.

8. DISCLAIMER OF WARRANTIES

LocalTitan services are provided "as is." We do not guarantee specific results, including a specific number of recovered leads, a specific star rating improvement, a specific number of social media followers, or a specific Google search ranking. Our statistics and client results reflect real outcomes but are not guarantees of your individual results.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law, LocalTitan's total liability to you for any claim arising from or related to these Terms or our services shall not exceed the total amount paid by you to LocalTitan in the three months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

10. GOVERNING LAW

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Ohio.

11. CHANGES TO TERMS

We may update these Terms from time to time. We will notify active clients of material changes via email. Continued use of our services after changes become effective constitutes your acceptance of the new Terms.
